Barry Neufeld Addresses the BCHRT 750,000.00 Fine Against Him For Refusing to Agree That There Are More Than 2 Genders

On Feb 17, 2026, —ASH WEDNESDAY— Devyn Cousineau, of the the BC Human Rights Tribunal, issued her decision in the case of the 8-year old complaint against me by the Chilliwack Teacher’s Association. The Tribunal found me guilty of hate speech for refusing to agree that there are more than two genders and ordered me to pay $750,000 to the Chilliwack Teacher’s Association to compensate the hurt feelings of their Queer union members.

I am sure they know I can never begin to pay this, but it sets a precedent, and in the future, no one else will ever dare to criticize their sacred Gender Ideology. So I must try to overturn this draconian decision.

We are applying for a judicial review at the BC Supreme Court, which is effectively an appeal to the “real” courts. This will be an expensive undertaking, but fundraising has already started and we are already moving forward with preparing the judicial review application and ordering a transcript of the hearing before the BCHRT. This will be expensive, because there were over 3 weeks of hearings: we need to hire an official Court Reporter to listen to the audio and type out a “trans”script.

Mr. Kitchen says reviews like this typically take one day in court, two days max. But this case has become so complex it could take three days or more. The Queer activist groups like EGALE, BC Attorney General, Kasari Govender’s Human Rights Commission, Skipping Stone Scholarship Foundation, Canadian Human Rights Commission, Canadian Civil Liberties Association, Community-Based Research Centre, Canadian Centre for Gender & Sexual Diversity, West Coast Legal Education and Action Fund, B.C. General Employees’ Union, EGALE Canada and Centre for Free Expression and Qmunity (A total of ELEVEN: all subsidized by taxpayers) will likely apply to be intervenors on behalf of the CTA. And you can trust the BC Courts will be too afraid to say no regardless of whether it legally makes sense for these groups to be involved.

Hopefully free speech organizations will also apply to the court to intervene on my behalf. The Free Speech Union, represented by Lisa Bildy (Amy Hamm’s lawyer) may be the first. I would really like to see an LGB group and a group representing detransitioners intervene as well, since members of those groups who I called to testify on my behalf at the BCHRT hearing were denied doing so by Ms. Cousineau of the Tribunal.

With the help of the Rights and Freedoms Fundraising Society (RFFS) and Billboard Chris Elston, I am raising the necessary funds for the judicial review.

In a way, the enormously huge penalty is a blessing in disguise. If it had only been $75,000 everyone would have ignored it and thought Barry Neufeld deserved it for being so outspoken. But Three quarters of a Million bucks shocked everyone into realizing that the BC Human Rights Tribunal is on a power trip, and there was even talk in the BC Legislature this morning about getting rid of the BCHRT. It has really stirred up international interest and sympathy for me as well as an increase of donations.
